Washington Medical Malpractice Insurance

There are multiple standard admitted A Rated carriers writing business in Washington. With the recent expansion of a standard admitted carrier into Washington, there may be further rate decreases on the horizon. Medical malpractice insurance is required by law in Washington and can be one of the more important lines of coverage for a doctor to purchase. Medical malpractice insurance helps to protect against claims that arise from patients claiming negligence on their doctor or caregiver.

Tort Reform and Changing Markets

In 2006 Legislature in Washington enacted comprehensive professional liability reform to address issues such as the cost and availability of medical malpractice insurance. One of the legislative reforms enacted in 2006 was reporting requirements for medical malpractice claims that are resolved and closed. The intent is to collect information so that Washington legislation can make informed decisions for the betterment of physicians, their patients, and also the insurance carriers who write Washington doctors.

According to the Washington Department of Insurance, the market for medical malpractice insurance is changing. Insurance carriers in Washington have noticed a shift in the nature of where Washington physicians practice medicine. Since the mid 2000s when the market turned hard, Washington doctors experienced large premium increases on their medical malpractice insurance. Seeking relief, many physicians became hospital employees in order to have their medical malpractice insurance under the hospital’s policy.

Smaller physician groups also consolidated into larger entities, which in turn led to fewer new and renewal business opportunities for Washington medical malpractice insurance carriers.

Washington Insurance Carriers

One of Washington State’s largest medical malpractice insurance carriers reduced its rates by 5.1 percent in 2011 and then again by 6.6 percent in 2012. Another regional carrier who controls a large portion of the market share in Washington has also decreased rates in recent years.

There can be advantages of choosing a larger medical malpractice insurance carrier over a regional carrier though. National carriers generally have larger reserves to cover losses than regional carriers, but another direct benefit of a national carrier is the ability to take your policy to another state that the national carrier writes policies in. This means that if you are a Washington doctor and decide that you want to move your practice to California, your policy will be able to follow you to California as long as the carrier who wrote your policy is licensed in the destination state.

Washington Medical Malpractice Insurance

Medical Malpractice Insurance, also called Medical Professional Liability Insurance or MPL Insurance coverage, is critical coverage to have in Washington. A small number of Washington medical doctors believe that once they are insured, that is everything they are able to do to protect themselves from a frivolous lawsuit, but that isn’t the case! Here are some ideas to help give protection to your practice:

  • Make sure to retain accurate records of all your patients along with the procedures performed. Accuracy and reliability or lack-there-of could certainly prove to be a factor when defending a claim.
  • Require signatures in advance to major procedures. By requiring signatures ahead of any major procedure, you are taking a great step in helping to protect your practice.
  • Customer Service is critical! Many patients who initiate malpractice lawsuits do it because they had a poor experience during the course of their visit. By making sure the patient is properly taken care of, as well as making sure their visit is positive as well as professional, you are able to potentially avoid a lawsuit.

Types of Polices
There's two standard kinds of insurance coverage existing. The majority of coverage created is usually on a claims made basis. Below is a straightforward summary regarding both categories of insurance coverage:

Claims-Made Coverage
Coverage that requires that a claim be made, as well as the insured party to document the claim to the insurance provider in the same policy period. This form of insurance is restricted to liability regarding those claims which take place from incidents or events that occur and also are reported to your insurance company insurance policy is in force. The claims-made insurance policy is in force from the starting date with the initial policy period (the retroactive date) and continues in force ranging from that date through each subsequent renewal. When a claims-made policy is terminated, future claims arising from occurrences that took place during the insurance policy period are not covered. Tail- coverage could also be added to the insured party’s insurance policy to insure past the date associated with termination of expressed policy

Occurrence Coverage
Gives protection structured on when the actual incident or injury actually happens; hence, claims as a result of injuries of which occurred within a policy’s effective dates are covered by the insurance policy, irrespective of whenever the claim is actually made in opposition to the Covered or introduced to the insurance carrier.

Maturation Factors/Step Factors
If you have a claims made insurance plan, your premium will increase yearly immediately after policy renewal for the initial 5-7 years. The first year premium is very low, which is due to the fact that you do not have a retroactive patient load from which claims could arise. As each year moves along, the prospect of a claim from prior services performed increases, therefore the actual premium will increase. This happens until the mature rate is reached.

With regard to occurrence insurance policies, the rate commences with the mature rate on the very first day you acquire an insurance policy.

Individual Physician - Preferred Risk
Medical malpractice insurers can handle an applicant as being a preferred risk in the event that they meet specific underwriting guidelines. The guidelines will be determined by the actual applicant's medical area of expertise, credentials including a favorable malpractice claims record. The major difference between the preferred and standard risk medical doctor, is usually that preferred risk physicians have got certain characteristics that place them within a special program sponsored by the insurance company.

Individual Physician - Standard Risk
Applicants that do not qualify as preferred risks and are not regarded as special risks will fall into the standard risk profile. Nearly all applicants will belong to this class of coverage.
